Terms of Service

These Terms of Service ("Terms") govern your use of the Vareaux online store, website and related services (the "Services").

The Vareaux store is operated by Vectoral, a Finnish sole proprietorship operating under the Vareaux brand ("Vareaux", "we", "us" or "our"). The Services are powered by Shopify, which provides the ecommerce platform through which we offer our products to you.

By accessing or using the Services, or by placing an order through the store, you agree to these Terms together with the policies referenced in them.

Nothing in these Terms limits or excludes any mandatory rights available to you under applicable consumer law.

1. Use of the Services

You may use the Services only for lawful purposes and in accordance with these Terms.

When providing information through the Services, including when placing an order, you agree to provide information that is accurate, current and complete.

If you create or use a customer account, you are responsible for maintaining the confidentiality of your account credentials and for notifying us if you become aware of unauthorised access to your account.

2. Products and Product Information

We make reasonable efforts to ensure that product descriptions, images, specifications, sizes, colours, prices and other information displayed through the Services are accurate.

The appearance of colours and other visual details may vary slightly depending on your device, display settings, lighting and other factors.

Product measurements are approximate and may be subject to normal manufacturing tolerances.

We may update product information or discontinue products from time to time. Changes will not affect an order that has already been accepted except where required to correct an error or comply with applicable law.

Your statutory rights relating to the conformity, quality and condition of goods are not affected by this section.

3. Orders and Contract Formation

When you submit an order through the store, you are offering to purchase the products in your order at the price and on the terms displayed during checkout.

After you place an order, you will receive an electronic confirmation containing information about the order. A binding contract is formed when your order is accepted in accordance with the checkout and order-confirmation process.

We may decline or cancel an order before fulfilment where there is a legitimate reason to do so, including product unavailability, payment failure, suspected fraud or misuse, an obvious pricing or technical error, inability to deliver to the requested destination, or a legal or regulatory restriction.

If we cancel an order after payment has been collected, we will refund the applicable amount using the original payment method unless another method is agreed with you.

Please review your order carefully before submitting it, including the product, colour, size, quantity and delivery information.

4. Prices, Taxes and Payment

Product prices are displayed in the currency shown on the store.

Before you submit an order, the checkout will display the total amount payable, including applicable product charges, taxes required to be collected by us, shipping charges and any other mandatory charges that are known and applicable to the transaction.

Prices may change from time to time, but a price change will not affect an order that has already been accepted.

Promotional offers or discounts may be subject to additional terms displayed with the relevant promotion.

You must use a payment method that you are authorised to use and provide accurate payment information.

Payments are processed through Shopify and/or the applicable payment service provider. We do not necessarily receive or store your complete payment-card details.

5. Shipping and Delivery

Available shipping destinations, shipping charges and estimated delivery times are displayed through the store or at checkout where applicable.

Delivery estimates are estimates unless expressly stated otherwise.

We will take reasonable steps to deliver your order within the agreed or legally required timeframe.

For consumer purchases, responsibility for loss of or damage to the goods remains with us until you, or a person designated by you other than the carrier, takes physical possession of the goods, except where applicable law provides otherwise.

More information about delivery, tracking, incorrect addresses, delayed shipments and undeliverable orders is available in our Shipping Policy.

6. Cancellations, Returns and Refunds

Consumers may have statutory rights to cancel or withdraw from online purchases, including the 14-day EU right of withdrawal where applicable.

Eligible return and cancellation requests can be submitted directly through your Vareaux customer account. Sign in to your account, open the relevant order and select the available Return items or Cancel items option.

You may also contact us at vareauxclub@gmail.com if you wish to exercise an applicable right of withdrawal or need assistance with a return or cancellation.

Cancellation requests are reviewed before being processed. If an order has already progressed too far for shipment to be stopped, this does not remove any statutory right of withdrawal that may apply.

Returns, withdrawal requests, refunds, damaged goods, defective goods and incorrect orders are handled in accordance with our Returns & Refunds Policy and applicable law.

Nothing in these Terms or our Returns & Refunds Policy limits any mandatory consumer rights relating to defective or non-conforming goods.

7. Intellectual Property

Unless otherwise stated, the content made available through the Services, including text, graphics, product designs, artwork, photographs, logos, branding, layout and other original material, is owned by or licensed to Vectoral and may be protected by copyright, trademark and other intellectual-property laws.

You may access and use the Services for your personal, non-commercial use.

You may not reproduce, distribute, publish, sell, commercially exploit, modify or create derivative works from protected Vareaux content without our prior permission, except where such use is permitted by applicable law.

"Vareaux" and associated branding may be protected as trade names, trademarks or other intellectual property. Nothing in these Terms grants you ownership of or a licence to use our branding for commercial purposes.

8. Third-Party Services and Links

The Services may include functionality, tools, payment services, links or other services provided by third parties.

Third-party services may be subject to their own terms and privacy policies. Where you choose to use a third-party service, you should review the applicable terms provided by that third party.

We are not responsible for the content or operation of third-party websites or services that are outside our reasonable control. This does not affect any liability that cannot legally be excluded.

9. Relationship With Shopify

Vareaux is powered by Shopify, which enables us to provide the Services to you. However, purchases made through our store are transactions directly between you and Vectoral operating under the Vareaux brand.

Shopify provides the ecommerce infrastructure supporting the store but is not the seller of Vareaux products.

10. Privacy

Our processing of personal information is described in our Privacy Policy.

Because the Services are hosted by Shopify, Shopify also processes certain information relating to your access to and use of the Services. Further information about Shopify's processing is available through the links contained in our Privacy Policy.

11. Customer Communications and Feedback

If you send us comments, suggestions, reviews, photographs or other feedback, you confirm that you have the right to provide that material.

Where you expressly submit material for publication, promotion or other public use, you grant us a non-exclusive, worldwide and royalty-free licence to use that material for the purpose for which it was submitted, subject to applicable law and any specific terms agreed with you.

You must not submit content that is unlawful, defamatory, infringing, fraudulent, malicious or that violates another person's rights.

12. Errors and Corrections

Despite reasonable efforts, the Services may occasionally contain typographical, technical or other errors relating to product information, availability, pricing, delivery information or other content.

We may correct errors and update inaccurate information.

If an obvious error materially affects an order you have already placed, we will contact you and handle the matter in accordance with applicable contract and consumer law. Where an order cannot be fulfilled because of such an error, any payment collected for the affected order will be refunded as appropriate.

13. Prohibited Uses

You must not use the Services:

  • for unlawful, fraudulent or malicious purposes;
  • to infringe our intellectual-property rights or the rights of another person;
  • to interfere with the security or proper operation of the Services;
  • to introduce malware, malicious code or other harmful material;
  • to obtain unauthorised access to accounts, systems or data;
  • to collect personal information about other users without a lawful basis;
  • to impersonate another person or misrepresent your identity;
  • to use the Services in a way that materially disrupts or damages the Services or the rights of others.

We may take reasonable steps to prevent or restrict misuse of the Services.

14. Availability of the Services

We aim to keep the Services available and functioning properly, but we do not guarantee uninterrupted or error-free access.

We may temporarily suspend or modify parts of the Services for maintenance, security, technical reasons or other legitimate operational purposes.

15. Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

In particular, nothing in these Terms limits mandatory consumer rights or any liability that cannot legally be excluded or restricted.

To the extent permitted by applicable law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed, or for losses arising from circumstances outside our reasonable control.

If you use the Services for purposes relating to a trade, business, craft or profession rather than as a consumer, additional limitations permitted by applicable law may apply.

16. Suspension or Termination of Access

We may restrict or terminate access to the Services where reasonably necessary, including in response to material breaches of these Terms, unlawful activity, fraud, security threats or misuse of the Services.

Termination of access does not affect rights or obligations that arose before the termination, including obligations relating to orders already accepted, payments, refunds or statutory consumer rights.

17. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be applied to the maximum extent permitted by law or, where necessary, severed from these Terms.

The remaining provisions will continue in effect.

18. Governing Law and Consumer Rights

These Terms and contracts entered into through the Services are governed by the laws of Finland, subject to any mandatory consumer-protection rules that apply to you in your country of residence.

If you are a consumer residing in another country, nothing in this section deprives you of any mandatory protection available to you under the laws that apply to your consumer contract.

Any dispute may be brought before a court that has jurisdiction under applicable law.

19. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Services, our business practices, applicable law or other legitimate operational reasons.

The current version will be published on this page together with the applicable "Last updated" date.

Changes to these Terms will not retroactively alter the terms applicable to a completed purchase unless required or permitted by law.

20. Entire Agreement

These Terms, together with the policies and information incorporated into them, form the agreement governing your use of the Services and purchases made through the store.

If a provision of these Terms conflicts with a mandatory consumer right, the mandatory consumer right will prevail.
